Why Indian Muslims Should Follow the Constitution of India

A Faithful Citizen’s Duty in a Diverse Nation

As Muslims living in India, we are guided not only by Islamic principles, but also by our civic duties under the Constitution of India — a democratic framework that guarantees justice, liberty, equality, and religious freedom.

1. Islam Commands Us to Honor Covenants
“Honor every agreement, for surely, every agreement will be held to account.” — Surah Al-Isra (17:34)
“O you who believe! Fulfill all contracts (obligations).” — Surah Al-Ma’idah (5:1)
A citizenship is an agreement (ʿahd) between a Muslim and their country. Therefore, by birth, a Muslim citizen of India is Islamically obliged to uphold the Constitution, as long as it doesn’t compel one to disobey Islam.

2. The Constitution Respects Religious Freedom
Article 25 – Freedom of Religion:
“All persons are equally entitled to freedom of conscience and the right to freely profess, practice and propagate religion.”
This means Muslims can:

(a) Practice Islam freely
(b) Build mosques and madrasas
(c) Follow personal laws (Nikah, Talaq, inheritance)
(d) Share Islamic teachings peacefully

3. Obeying Just Authority is Encouraged in Islam

“Obedience is only in what is right.” — Sahih al-Bukhari & Sahih Muslim

If the law doesn’t contradict Islam, obeying it helps maintain order, peace, and justice, all of which are core values of the Shariah.

4. Justice and Equality Are Shared Goals

The Constitution stands for:

(a) No discrimination based on religion
(b) Equality before law
(c) Right to education, work, and vote
(d) Protection of minority rights

These values align with Islamic justice (Adl), one of Allah’s names is Al-Adl — The Just.

5. A True Believer Respects and Loves Their Homeland
“Loving one’s homeland is a reflection of faith.” — A widely accepted Islamic principle
Being loyal, honest, and contributing to your country’s wellbeing is part of being a good Muslim.

6. What If There’s a Conflict?

When a law contradicts Islamic teachings, Islam teaches us to object through peaceful, constitutional means — not violence.

Use:

(a) Legal petitions
(b) Public representation
(c) Peaceful protest
(d) Media and dialogue
